Copyright release




In order to use any copyright protected material, you will have to obtain a copyright release from the owner of the copyright to the work. Now that's easier said than done, short of strong-arming him or her into it, you probably will have to compensate the copyright holder in some way. But what is actually a copyright release, how does it look like and what needs to be written in there?


As already mentioned, the copyright release form permits the designated person to use the copyrighted material or work in the manner defined within the agreement and shall be clearly outlined within the copyright release document.


While some copyright release forms are pretty straight forward, like, I, the copyright holder of the document "whichever", allow this and that person to - this is an example, obviously - make thirteen copies of my brochure "how to jump out of the window without breaking the glass". On a serious note, a release form does not have to be elaborate at all.

 

Nowadays, lawyers may contest any document in existence, so it does not really matter how perfect your writ is, it matters that you clearly define what you are allowing and what not. If someone is dead set to infringe your copyright, he or she will do so, this copyright release is there to keep up the laws and regulations and clearly explain what the other party may and may not do with your material. Don't make a science out of it, unless science is what you are peddling.


Some copyright release forms are integrated in an agreement with the company that is about to exploit your original work for mutual benefit. Such copyright releases are very elaborate and filled with tiny paragraphs and plenty of words. Beware, anything that is written in your agreement has a reason why it's there, so if in the tiniest release form there is one sentence or there are five pages, there is a reason why a lawyer put that stuff in there.


Also if you intend to release a piece of work into public domain, then you need to state this publicly and with a certain wording as defined by the copyright law.
Nevertheless, a proper copyright release form has to encompass the owner of the copyright, the designated licensee of the copyright, the conditions of the licensing with all the limitations and the exact name and definition of the copyrighted work that is the subject of the copyright release form. Other details may be included but are not essentially necessary.
